Cass Sunstein is a Harvard-educated legal scholar who began his career in the Justice Department’s Office of Legal Counsel and moved on to become a Professor at the University of Chicago Law School.  President Obama appointed Mr. Sunstein to the position of Administrator of the Office of Information and Regulatory Affairs.  In case you’re wondering what that bureaucracy does, a visit to its website will reveal this:

The Office of Information and Regulatory Affairs (OIRA) is located within the Office of Management and Budget and was created by Congress with the enactment of the Paperwork Reduction Act of 1980 (PRA).  OIRA carries out several important functions, including reducing paperwork burdens, reviewing federal regulations, and overseeing policies relating to privacy, information quality, and statistical programs.

On January 12, Daniel Tencer of The Raw Story website, pointed out that Mr. Sunstein co-authored a paper with Adrian Vermule, published in the Journal of Political Philosophy in 2008 entitled, “Conspiracy Theories: Causes and Cures”.  Here is some of what Mr. Tencer had to say about that paper, while quoting fellow critic, Marc Estrin:

Sunstein argued that “government might undertake (legal) tactics for breaking up the tight cognitive clusters of extremist theories.”  He suggested that “government agents (and their allies) might enter chat rooms, online social networks, or even real-space groups and attempt to undermine percolating conspiracy theories by raising doubts about their factual premises, causal logic or implications for political action.”

“We expect such tactics from undercover cops, or FBI,” Estrin writes at the Rag Blog, expressing surprise that “a high-level presidential advisor” would support such a strategy.

Estrin notes that Sunstein advocates in his article for the infiltration of “extremist” groups so that it undermines the groups’ confidence to the extent that “new recruits will be suspect and participants in the group’s virtual networks will doubt each other’s bona fides.”

At Salon.com, Glenn Greenwald (an attorney who has litigated cases based on Constitutional law issues) expressed outrage that President Obama would be so closely tied to someone with such views:

There’s no evidence that the Obama administration has actually implemented a program exactly of the type advocated by Sunstein, though in light of this paper and the fact that Sunstein’s position would include exactly such policies, that question certainly ought to be asked.  Regardless, Sunstein’s closeness to the President, as well as the highly influential position he occupies, merits an examination of the mentality behind what he wrote.  This isn’t an instance where some government official wrote a bizarre paper in college 30 years ago about matters unrelated to his official powers; this was written 18 months ago, at a time when the ascendancy of Sunstein’s close friend to the Presidency looked likely, in exactly the area he now oversees.

What is most odious and revealing about Sunstein’s worldview is his condescending, self-loving belief that “false conspiracy theories” are largely the province of fringe, ignorant Internet masses and the Muslim world.  That, he claims, is where these conspiracy theories thrive most vibrantly, and he focuses on various 9/11 theories — both domestically and in Muslim countries — as his prime example.

It’s certainly true that one can easily find irrational conspiracy theories in those venues, but some of the most destructive “false conspiracy theories” have emanated from the very entity Sunstein wants to endow with covert propaganda power: namely, the U.S. Government itself, along with its elite media defenders.  Moreover, “crazy conspiracy theorist” has long been the favorite epithet of those same parties to discredit people trying to expose elite wrongdoing and corruption.

Sunstein also advocated the use of  “credible independent experts” to be hired and paid by the government to add a veneer of credibility to government positions.  The relevance of this point to the controversy over Jonathan Gruber (the MIT professor who received undisclosed payments to promote the President’s healthcare plan) resulted in a situation where that issue became the most widely-discussed aspect of Greenwald’s piece.  By taking issue with Greenwald, Paul Krugman took advantage of the opportunity to get a little egg on his own face with a blog posting at his New York Times-based site.  Greenwald had no difficulty exposing the flawed rationale of Krugman’s retort on January 16.

I would like to see the debate refocus on the original point:  the idea that the government should get involved in debunking “conspiracy theories”.  That term is used by all types of pundits to invalidate any point of view contrary to their own.  As Daniel Tencer explained in his Raw Story piece, Sunstein used the term “crippled epistemology” to support the contention that people who believe in conspiracy theories have a limited number of sources of information that they trust.  I believe that Sunstein and his ilk have it backwards.  By their constant attempts to tar “the Internet” as the wellspring of so many “conspiracy theories” – they are acting to limit the number of trustworthy sources of information with their own counterintelligence tactics.

The greater question concerns why it would be so important for the government to get involved in this type of activity.  In the case of the 9/11 conspiracy theories, there is the obvious concern that Al Queda or some similarly-inclined group would want to cultivate an online network of kindred spirits who might potentially be of service to such an organization.  Does that mean that anyone who suspects some degree of cover-up concerning some aspect of that tragedy should be treated as a potential “enemy combatant”?  What other “conspiracy groups” would be targeted by such operations?  Who would determine whether a particular conspiracy theory becomes the focus of such an effort and what would be the criteria for making such a determination?  As Glenn Greenwald’s January 15 essay demonstrates, once the government embarks on such a course, there is unlimited potential for abuse.  Worse yet, the government’s use of such tactics should cause any such government “information control” efforts to self-destruct.  Greenwald put it this way:

The reason conspiracy theories resonate so much is precisely that people have learned — rationally — to distrust government actions and statements.  Sunstein’s proposed covert propaganda scheme is a perfect illustration of why that is.  In other words, people don’t trust the Government and “conspiracy theories” are so pervasive precisely because government is typically filled with people like Cass Sunstein, who think that systematic deceit and government-sponsored manipulation are justified by their own Goodness and Superior Wisdom.

In other words, this is a battle the government has already lost.  A program to conspire against conspiracy groups could serve no other purpose but to validate the claims made by those groups.

For some reason, the Boston College School of Law invited Federal Reserve Chairman, B.S. Bernanke, to deliver the commencement address to the class of 2009 on May 22.  While reading the text of that oration, I found the candor of this remark at the beginning of his speech, to be quite refreshing:

Along those lines, last spring I was nearby in Cambridge, speaking at Harvard University’s Class Day.  The speaker at the main event, the Harvard graduation the next day, was J. K. Rowling, author of the Harry Potter books.  Before my remarks, the student who introduced me took note of the fact that the senior class had chosen as their speakers Ben Bernanke and J. K. Rowling, or, as he put it, “two of the great masters of children’s fantasy fiction.”  I will say that I am perfectly happy to be associated, even in such a tenuous way, with Ms. Rowling, who has done more for children’s literacy than any government program I know of.

Meanwhile, that great master of children’s fantasy fiction (and money printing) is now faced with the possibility that someday, someone might actually start looking over his shoulder in attempt to get some vague idea of just what the hell is going on over at the Federal Reserve.

The Federal Reserve’s resistance to transparency has been a favorite topic of many commentators.  For example, once Ben Bernanke took over the Fed Chairmanship from Alan Greenspan in 2006, Ralph Nader expressed his high hopes that Bernanke might adopt Nader’s suggested “seven policies of openness”.  Dream on, Ralph!

Speaking of children’s fantasy fiction, one expert on that subject is Congressman Alan Grayson.  As the Representative of Florida’s Eighth Congressional District, his territory includes Disney World.  Thus, it should come as no surprise that back in January of 2009, as a new member of the House Financial Services Committee, he immediately set about cross-examining Federal Reserve Vice-Chairman Donald Kohn about what had been done with the 1.2 trillion dollars in bank bailout money squandered by the Fed after September 1, 2008.  Glenn Greenwald of Salon.com provided a five-minute video clip of that testimony along with an audio recording of his 20-minute interview with Congressman Grayson, focusing on the complete lack of transparency at the Federal Reserve.

Better yet was Congressman Grayson’s questioning of Federal Reserve Board Inspector General Elizabeth Coleman on May 7.  In one of the classic “WTF Moments” of all time, Ms. Coleman admitted that she had no clue about the “off balance sheet transactions” by the Federal Reserve, reported by Bloomberg News as amounting to over nine trillion dollars in the previous eight months.  If you haven’t seen this yet, you can watch it here.  After reviewing this video clip, Yves Smith of Naked Capitalism was of the opinion that Coleman was not stonewalling, but instead was “clearly completely clueless”.  Ms. Smith pointed out how opacity at the Federal Reserve may be by design, with the apparent motive being obfuscation:

But there is a possibly more important issue at stake.  The interview is with the Inspector General of the Federal Reserve Board of Governors.  The programs are actually at the Federal Reserve Bank of New York.  For reasons I cannot fathom, the Board of Governors is subject to Freedom of Information Act requests, while the Fed of New York has been able to rebuff them.

So I take Coleman’s inability to answer key questions to be a feature, not a bug.  The Fed of New York probably can answer Congressional questions, is taking care to limit what it conveys to the Board so as to keep the information from Congress and the public.  Note in the questioning the emphasis on “high level reviews”.

In order to shine a bright light on the Federal Reserve, Republican Congressman Ron Paul of Texas has introduced the Federal Reserve Transparency Act, (H.R. 1207) which would give the Government Accountability Office the authority to audit the Federal Reserve and its member components, and require a report to Congress by the end of 2010.  On May 21, Congressman Alan Grayson wrote to his Democratic colleagues in the House, asking them to co-sponsor the bill.  Among the many interesting points made in his letter were the following:

Furthermore, the Federal Reserve has refused multiple inquiries from both the House and the Senate to disclose who is receiving trillions of dollars from the central banking system.  The Federal Reserve has redacted the central terms of the no-bid contracts it has issued to Wall Street firms like Blackrock and PIMCO, without disclosure required of the Treasury, and is participating in new and exotic programs like the trillion-dollar TALF to leverage the Treasury’s balance sheet.  With discussions of allocating even more power to the Federal Reserve as the “systemic risk regulator” of the credit markets, more oversight over the central bank’s operations is clearly necessary.

The net effect of recent actions has been to isolate financial policy-making entirely from democratic input, and allow the Treasury Department to leverage the Federal Reserve’s balance sheet to spend money it cannot get appropriated from Congress.  The public does not know where trillions of its dollars are going, and so has no meaningful control over the currency or this unappropriated “budget”.  The extraordinary size of these lending facilities combined, the extreme secrecy, and the private influence is a dangerous seizure of Congress’s constitutional prerogative to appropriate public monies and control the currency.

You can do your part for this cause by signing the on-line petition.  Let Congress know that we will no longer tolerate “children’s fantasy fiction” from the Federal Reserve.  Demand an audit of the Federal Reserve as well as a report to the public of what that audit reveals.

When Barack Obama began his Presidential campaign, I was initially skeptical.  Here was another guy from “out of the blue” pursuing a bid for the White House.  I was reminded of Jimmy Carter:  a man who had served a term as Governor of Georgia, who began his Presidential campaign with little name recognition.  Carter’s Presidency was marked by rampant inflation and an ill-advised decision to allow Iran’s ailing, deposed Shah into the United States (from exile in Mexico) to die here.  That move resulted in the attack on the U.S. Embassy in Iran, and the holding of 52 American diplomats as hostages until the end of Carter’s term in office.  Teddy Kennedy unsuccessfully challenged Carter for the Democratic nomination in 1980, knowing that Carter had little chance of re-election.   After serving only one term as President, Carter was voted out of office.

At the outset, Carter’s Presidential campaign got a lot of traction from the widespread belief among young voters that Carter would do something to change our nation’s marijuana laws.  Not only did Carter lack the political courage to take such a stand once he became President, he did the opposite.  Carter authorized the use of an herbicide called Paraquat, to be sprayed on marijuana fields in Colombia and Mexico.  Upon realizing that their crops were sprayed with this substance, the sleazy pot farmers quickly harvested the contaminated weed and sent it to market in the United States.  As a result, many Americans developed permanent respiratory problems.

Now that the Obama Administration has taken a “States’ rights” position on medical marijuana laws (by refusing to continue the Bush administration’s tactic of prosecuting medical marijuana facilities) proponents for repeal of pot prohibition, have stepped up their campaign.  Given the current economic crisis, now might be the time for the government to consider legalizing marijuana and taxing it, as is done with the more dangerous ethyl alcohol.

On Thursday, March 26, President Obama held a “town hall” meeting in the East Room of the White House.  Although there were only 100 audience members in the East Room, viewers were invited to submit questions over the Internet.  Nearly 100,000 questions were submitted on-line in response to this invitation.  As John Ward Anderson reported for Politico:

In this moment of national economic crisis, the top four questions under the heading of “Financial security” concerned marijuana; on the budget, people voted up questions about marijuana to positions 1-4; marijuana was in the first and third positions under “jobs”; people boosted a plug for legalizing marijuana to No. 2 under “health care reform.”  And questions about decriminalizing pot occupied spots 1 and 2 under “green jobs and energy.”

After taking questions lower on the list, Obama addressed the pot issue head-on, noting the huge number of questions about marijuana legalization and remarking with a chuckle, “I don’t know what that says about the online audience.”

“The answer is no, I don’t think that is a good strategy to grow our economy,” he said, as the audience in the room applauded and joined him in a laugh.

Although the enthusiastic sycophants in the audience shared a chuckle with the President, many commentators took a dim view of Obama’s discourteous response.  Conservative pundit Andrew Sullivan was particularly incensed by the President’s affront to “the online audience”:

The chuckle suggests a man of his generation.  The dismissiveness toward the question of ending Prohibition as both a good in itself and a form of tax revenue is, however, depressing.  His answer was a non-answer.  I’m tired of having the Prohibition issue treated as if it’s trivial or a joke.  It is neither.  It is about freedom and it’s deadly serious.  As for your online audience, Mr president, have you forgotten who got you elected?

On his blog at Salon.com, Pete Guither took stock of reactions to the President’s superciliousness from across the blogosphere.  Many of the rejoinders he quoted came from people at The Huffington Post.  I will include some of them here.

Jim Gilliam said:

Pot saved my life. It’s a miracle drug, even the crappy non-organic kind made in a lab.

The President will be asked this question again, and maybe next time he won’t laugh at us.

Sam Stein’s retort included the reaction of a law enforcement professional:

Jack Cole, executive director of Law Enforcement Against Prohibition (LEAP), said in response:

“Despite the president’s flippant comments today, the grievous harms of marijuana prohibition are no laughing matter. Certainly, the 800,000 people arrested last year on marijuana charges find nothing funny about it, nor do the millions of Americans struggling in this sluggish economy.  It would be an enormous economic stimulus if we stopped wasting so much money arresting and locking people up for nonviolent drug offenses and instead brought in new tax revenue from legal sales, just as we did when ended alcohol prohibition 75 years ago during the Great Depression.”

Dan Sweeney had this to say:

According to Arizona Attorney General Terry Goddard fully 75 percent of Mexican drug cartels’ cash comes from the sale of marijuana.  Legalizing marijuana would, of course, take away that massive source of income for the cartels, just as ending prohibition cut bootlegging as a source of revenue for La Cosa Nostra.

Combining all of the above effects, the legalization of marijuana means billions of dollars saved or made, the creation of jobs and the curbing of violence along the Mexican border, which in turn means saving thousands of lives.

Barack Obama can certainly be against legalization, but he owes it to nonviolent drug offenders caught in the horror show that is the U.S. prison system, the families of innocent victims of the Mexican drug wars and economically bloodied U.S. taxpayers to explain why. Ganja may cause the giggles, but legalization shouldn’t be a laughing matter.  And it certainly shouldn’t be treated as cavalierly as it has by the current administration, especially when it has been proven to be a popular issue every time Obama has tried to go straight to the people.

President Obama’s expressed position on the marijuana issue demonstrates the same political cowardice America witnessed in Jimmy Carter.  If you want to read an uplifting story about political courage, Constitutional law and civil rights attorney, Glenn Greenwald, wrote an excellent piece concerning Virginia Senator Jim Webb’s political courage for Salon.com.  Not surprisingly, the example Mr. Greenwald chose to contrast with Jim Webb’s political bravery was President Obama’s “adolescent, condescending snickering when asked about marijuana legalization”.  The marijuana controversy presents our new President with the opportunity to demonstrate the same degree of political courage exhibited by Jim Webb.  He ought to give it a try.

It was almost one year ago when the conservative National Journal rated Barack Obama as “the most liberal senator in 2007”.  Of course, that was back during the primary season of the 2008 Presidential campaign, when many people believed that the “liberal” moniker should have been enough to sink Obama’s Presidential aspirations.  Now, with the Inaugural just a week away, we are hearing the term “centrist” being used to describe Obama, often with a tone of disappointment.

On Sunday, January 11, David Ignatius wrote an op-ed piece for The Washington Post, entitled:  “Mr. Cool’s Centrist Gamble”.  Mr. Ignatius spelled out how Obama moved toward the political center after his election, beginning with the appointment of Rahm Emanuel as chief of staff, to appointing a Cabinet “which is so centrist it almost resembles a government of national unity”:

Since Election Day, he has taken a series of steps to co-opt his opponents and fashion a new governing majority.  It’s an admirable strategy but also a high-risk one, since the “center,” however attractive it may be in principle, is often a nebulous political never-never land.

Obama’s bet is that at a time of national economic crisis, the country truly wants unity.

The President-elect’s appearance on ABC’s January 11 broadcast of This Week with George Stephanopoulos motivated Glenn Greenwald to write on Salon.com that the interview:

. . .  provides the most compelling — and most alarming — evidence yet that all of the “centrist” and “post-partisan” chatter from Obama’s supporters will mean what it typically means:  devotion, first and foremost, to perpetuating rather than challenging how the Washington establishment functions.

Mr. Greenwald (an attorney with a background in constitutional law and civil rights litigation) began his article by taking issue with the characterization by David Ignatius that Obama’s centrist approach is something “new”.  Greenwald pointed out that for a Democratic President to make a post-election move to the center is nothing new and that Bill Clinton had done the same thing:

The notion that Democrats must spurn their left-wing base and move to the “non-ideological” center is the most conventional of conventional Beltway wisdom (which is why Ignatius, the most conventional of Beltway pundits, is preaching it).  That’s how Democrats earn their Seriousness credentials, and it’s been that way for decades.

Greenwald then focused on a point made by Mr. Obama in response to a question posed by George Stephanopoulos concerning whether the detention facility at Guantanamo will be closed within the first 100 days of the new Presidency.  The President-elect responded that:

It is more difficult than I think a lot of people realize and we are going to get it done but part of the challenge that you have is that you have a bunch of folks that have been detained, many of whom who may be very dangerous who have not been put on trial or have not gone through some adjudication.  And some of the evidence against them may be tainted even though it’s true.  And so how to balance creating a process that adheres to rule of law, habeas corpus, basic principles of Anglo American legal system, by doing it in a way that doesn’t result in releasing people who are intent on blowing us up.

The magic words in Obama’s response that caught Glenn Greenwald’s attention were:  “creating a process”.  Why should due process require creation of a new process outside of our court system?  Mr. Greenwald suspects that this “new process” will be one that allows for the admission of evidence (confessions, etc.) obtained by torture.  If what Mr. Obama has in mind is a process that will protect the secrecy of legitimately-classified information, that is one thing.  Nevertheless, I share Mr. Greenwald’s skepticism about the need for an innovative adjudication system for those detained at Guantanamo.

George Stephanopoulos made a point of directing Mr. Obama’s attention to “the most popular question” on the Change.gov website.  It came from Bob Fertik of New York City, who asked:

Will you appoint a special prosecutor ideally Patrick Fitzgerald to independently investigate the greatest crimes of the Bush administration, including torture and warrantless wiretapping?

The response given by the President-elect involved a little footwork:

We have not made final decisions, but my instinct is for us to focus on how do we make sure that moving forward we are doing the right thing.

Glenn Greenwald’s analysis of Mr. Obama’s performance on This Week, did not overlook that part of the interview:

Obama didn’t categorically rule out prosecutions — he paid passing lip service to the pretty idea that “nobody is above the law,” implied Eric Holder would have some role in making these decisions, and said “we’re going to be looking at past practices” — but he clearly intended to convey his emphatic view that he opposes “past-looking” investigations.  In the U.S., high political officials aren’t investigated, let alone held accountable, for lawbreaking, and that is rather clearly something Obama has no intention of changing.

Obama’s expressed position on whether to prosecute the crimes of the Bush administration is fairly consistent with what he has been saying all along.  Frank Rich covered this subject in his January 10 New York Times editorial:

The biggest question hovering over all this history, however, concerns the future more than the past.  If we get bogged down in adjudicating every Bush White House wrong, how will we have the energy, time or focus to deal with the all-hands-on-deck crises that this administration’s malfeasance and ineptitude have bequeathed us?  The president-elect himself struck this note last spring.  “If crimes have been committed, they should be investigated,” Barack Obama said.  “I would not want my first term consumed by what was perceived on the part of Republicans as a partisan witch hunt, because I think we’ve got too many problems we’ve got to solve.”

Henry Waxman, the California congressman who has been our most tireless inquisitor into Bush scandals, essentially agreed when I spoke to him last week.  Though he remains outraged about both the chicanery used to sell the Iraq war and the administration’s overall abuse of power, he adds:  “I don’t see Congress pursuing it. We’ve got to move on to other issues.”  He would rather see any prosecutions augmented by an independent investigation that fills in the historical record.  “We need to depoliticize it,” he says.  “If a Democratic Congress or administration pursues it, it will be seen as partisan.”

Welcome to Barack Obama’s post-partisan world.  The people at the National Journal are probably not the only ones disappointed by Obama’s apparent move to the political center.  It appears as though we will be hearing criticism about the new administration from all directions.  When he disappoints centrists, you can read about it here.
